- Trade Secret
- Injunction
- Practice, Civil, Preliminary injunction, Presumptions and burden of proof
- Evidence, Presumptions and burden of proof
The plaintiff, Daikin Applied Americas Inc. (Daikin), filed suit alleging that former employees, Joseph Russo and Andrew Porter, accessed and, together with their newly formed company, RPAC LLC (RPAC), used Daikin's confidential and trade secret information without Daikin's consent. With the exception of one document, the defendants have denied that the information they took was "confidential or proprietary." Nevertheless, at a hearing on Daikin's motion for a preliminary injunction, the defendants agreed not to use, and to return, any confidential information in their possession.
